CONTACT A MIDLAND EMPLOYMENT LAW ATTORNEY
In the state of Texas, most non-exempt, hourly workers are entitled to be paid one and a half times their regular rate of pay for any time worked exceeding 40 hours. If an employer fails to pay their employees the appropriate compensation for their overtime, the employee often has a right to sue for their unpaid earnings. If your employer has taken advantage of you and failed to pay your fair share of overtime wages, a Midland employment lawyer from Moore & Associates can fight for your rights and represent your interests in a court of law.

Ways That Employers Cheat the System
One of the most common ways that employers try to get away with not paying their employees for their overtime hours is by incorrectly classifying them as exempt, falsely claiming that a worker is not eligible to receive overtime. Intentionally miscalculating or “forgetting” about overtime hours is another common scheme, along with encouraging employees to work off the clock. If your employer uses any of these tactics, there is a good chance that you are being cheated.
Who Is Not Entitled to Overtime?
There are a few exceptions to the overtime rule. Generally speaking, if an employee is paid a salary of at least $455 per week, they may be considered an exempt employee.
The following people are generally ineligible to receive overtime pay:
- High-level executives
- Administrators
- professionals
- Babysitters
- Outside sales representatives
- Farmers and fishermen
Being paid a salary is not a catch-all method of avoiding paying overtime, however, as there are salaried occupations that are still considered non-exempt. Consulting with an attorney from our firm is the best way to determine if you are eligible to receive overtime pay. If we believe you have been unfairly compensated for your work, we can evaluate your situation and help you pursue the most appropriate course of legal action.
