Current Minimum Wage
Based on the Fair Labor Standards Act, the federal minimum wage must be paid by all employers. Currently, the minimum federal wage is $7.25 per hour. If, however, the individual is a “tipped employee” he or she can be paid less. Employers must pay all tipped employees at least $2.13 an hour, regardless of how much tips. A tipped employee is one who receives tips from patrons in exchange for the service that they provide. For this arrangement to occur, the service provider must regularly earn a minimum of $30 per month in tips.
If you are facing a violation involving your allotted tips, reach out to our Houston employment lawyer today to schedule your case evaluation.
HOW TO RESOLVE A TIP POOL VIOLATION CASE
In a workplace where a tip pool is available and the proceeds are distributed among employees who do not directly interact with customers, or customarily do not receive tips (cooks, dishwashers, mangers, etc.), the company may be violating the tip pool laws. Another possible violation is when an employer pays a non-tipped employee less than minimum wage but uses the tip pool to bring the employee up to minimum wage.
